Terms of service
The agreement covering your use of the Yarnova app and this website, including what you may do with patterns and what happens to the work you create.
These terms form an agreement between you and Yarnova covering your use of the Yarnova iPhone app and yarnova.com. Please read them before using either.
1. Acceptance
By downloading, installing or using Yarnova, you agree to these terms. If you do not agree to them, do not use the app.
Yarnova is distributed through the Apple App Store, so Apple's Media Services Terms and Conditions apply alongside these terms. Where the two conflict on something Apple governs, such as payment or refunds, Apple's terms take precedence.
2. Your licence to use Yarnova
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Yarnova on Apple devices that you own or control, in line with Apple's Usage Rules.
Making items with Yarnova and selling those finished items is permitted by us, subject to section 5 where the pattern belongs to another designer.
3. What you may not do
- Copy, sell, sublicense, rent or redistribute the app itself
- Reverse engineer, decompile or attempt to derive the source code, except where that restriction is prohibited by law
- Remove or obscure any copyright or ownership notice
- Use the app to infringe anyone's intellectual property rights
- Use the app in a way that breaks the law where you live
4. Your content
Anything you create in the app remains yours: your projects, notes, stash entries, photographs and timings. We claim no ownership of it and take no licence over it.
Because that content is stored on your device rather than on our servers, keeping backups is your responsibility. We recommend leaving iOS device backups enabled. We cannot recover content lost when a device is lost or reset, or when the app is deleted.
5. Patterns and intellectual property
The app itself, including its design, code, text, branding and the Yarnova name, belongs to us and is protected by copyright and trade mark law.
Patterns provided in the app are licensed to you for your personal crafting use. You may make items from them. You may not redistribute, resell or republish the patterns themselves.
Patterns by other designers
Where you add or work from a pattern created by someone else, that designer's licence governs it, not ours. Many independent designers allow you to sell finished items while prohibiting sharing the pattern file. Check the terms that came with the pattern, and credit designers where they ask for it.
6. Purchases and subscriptions
Any paid features are sold through the App Store. Payment is taken by Apple using the payment method on your Apple Account.
Where a purchase is a subscription, it renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in iOS Settings › your name › Subscriptions. Deleting the app does not cancel a subscription.
Refunds are handled by Apple rather than by us, through reportaproblem.apple.com.
7. Availability and changes
We aim to keep Yarnova working well and to fix problems promptly, but we do not guarantee that it will be uninterrupted or error-free. Features may be added, changed or withdrawn as the app develops, and support for older versions of iOS may end.
8. Disclaimer
Yarnova is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Time estimates, gauge guidance, conversion charts and pricing calculations are provided as guidance only. Yarn behaves differently between brands, dye lots and hands, so check your own gauge before committing to a project.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of Yarnova, including lost projects, lost data or wasted materials. Our total liability in any circumstance will not exceed the greater of the amount you paid us in the twelve months before the claim, or ten pounds sterling.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, these terms do not affect your statutory rights.
10. Termination
You may end this agreement at any time by deleting the app. We may suspend or end your licence if you materially breach these terms. Sections 4, 5, 8, 9 and 11 survive termination.
11. Governing law
These terms are governed by the law of the jurisdiction in which Yarnova is established, whose courts have non-exclusive jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country where you live, and you may bring proceedings there.
12. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page. Continuing to use the app after an update means you accept the revised terms. If you do not accept them, stop using the app and delete it.
13. A note about Apple
Apple is not a party to these terms and has no responsibility for the app, including any obligation to provide support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
